[THE COMPUTERY] Customer Agreement

I. Health and Safety Statement

A. During our time spent at your home or business, we may have to take precautions that are required to maintain proper sanitary guidelines, as well as prevent the technician, or the customer from passing any sort of germs to each other. An operable restroom must readily be available for the technician to use at all times. An appropriate trash/garbage receptacle must be readily available for the technician to use at all times. I agree that cleaning up of the inside of the electronic devices may be done as a courtesy (for example, blowing dust out of a computer chassis), but it is not required per our agreement.

II. Remote Options

A. We are proud to offer the many remote options available to you if you would much rather not have a technician come to your home or office. If you choose to use this service, a working internet connection must be available, and the computer must be able to turn on all the way, and boot up to the desktop or login/sign in screen.

III. Scheduling Conflicts

A. If you are sick, please reschedule or utilize remote options. If we are sick, we will reschedule, and attempt to utilize the remote options. 

B. I understand that I may be charged up to $125 for cancelling an appointment when there is less than 24 hours until the appointment time to my credit card that I have provided to be placed on file. This charge is a valid charge, and not able to be charged back by the bank.

IV. Liability

A. I, the undersigned, agree to allow neurodiversity, LLC (“neurodiversity”, “company”, “technician”) to perform work on my computer, smartphone, tablet, network, or other electronic devices within the scope of the job. I understand that the company can not be held liable for any data loss, destruction, or damage to my devices while service is being performed. If I am not comfortable with the service being performed, I will be sure to promptly notify the technician to have the work be stopped immediately. I understand that I may still be charged for services performed if ordered to stop.

V. Autism Statement

A. Because our business thrives on the hiring, and daily operations consists of autistic individuals, I understand that the exhibition of rude behaviors, yelling, threatening, confrontational behavior, etc, will not be tolerated. I understand that work can be stopped at anytime if I, the customer, exhibit this type of behavior. I also understand that my behavior will not absolve me from any trip or service charges that I have already incurred and accrued, and will be billed accordingly. I understand that all bills will still be required to pay in full by the time we exit your premises, or the appropriate authorities will be notified, including but not limited to, the Maricopa County Sheriffs Office, City of Scottsdale Police Department, City of Tempe Police Department, City of Chandler Police Department, City of Phoenix Police Department, City of Mesa Police Department any other applicable Police Department or any applicable Civil Court.

B. I understand that this policy applies when communicating in any way to the technician, including, but not limited to, in person, text messages, phone calls, SMS text messages, or messages provided through any sort of messaging service, such as iMessage, Facebook Messenger, or Square’s built in messaging tools.

VI. Payments

A. When using a Credit or Debit card (including services such as Apple Pay), or money transfer service such as Zelle, PayPal, Venmo, CashApp, etc, I understand that a charge back is not allowed per our agreement. I agree to attempt to solve any problems I have with my service with the technician or company directly, rather than initiating a chargeback with my bank.

B. If checks are considered to be accepted for services, I agree to have the funds available in my account for the check to be able to clear. I understand that I, the customer, will be charged a $25 fee in addition to any applicable fees, fines, as well as the original cost of the service, for any bounced check, and understand that it is against the law to knowingly write a bad check.

C. If cash is considered to be accepted for the services, I agree that I knowingly know that all bills provided are authentic, and not altered in anyway. Any counterfeit monies will be reported to the appropriate authorities as required by law.

VII. Refunds and Warranty

A. Due to the nature of how computers work, there are no warranties expressed or implied with your service. There are no refunds on any services performed, and there are no refunds on physical products purchased through the company, if the item has already been installed on my premises.
B. Though there are to be no refunds, in the unlikely event there is, refunds will not be in cash, and may be returned to you in the form of a) a check, b)gift card/service credit, or c) electronically through a money transfer service, at the discretion of the company.
C. Any manufacturers provided warranty will still be valid, depending on the product purchased. I agree that any manufacturer issues will be dealt with between I, the customer, and the manufacturer of the item. The company should not be considered an intermediary or middleman between the customer and the manufacturer.

VIII. Government

A. I understand that this agreement is fully enforceable to the fullest extent of the law.
B. This agreement is governed by the State of Arizona, where neurodiversity, LLC is registered.
C. This agreement is governed by the county of Maricopa, where neurodiversity, LLC is registered.
D. This agreement is governed by the Town of Fountain Hills, where neurodiversity, LLC is located.
E. This agreement is governed by the laws of the United States of America, where neurodiversity, LLC is located.
F. In the event that any court of law finds a portion of this agreement unenforceable, the rest
of the agreement will still remain enforceable to the point where legally possible.

IX. Litigation Rights
A. By signing this agreement, I acknowledge that I waive my right to litigation or arbitration against neurodiversity, LLC, owners of neurodiversity LLC, any designated employees or contractors of neurodiversity, LLC. If in the event that a court action is required, a private arbitrator chosen by neurodiversity, LLC will be used instead of a governmental court. I acknowledge that I would be responsible for any attorney’s costs, and arbitration costs.
B. I waive my right as much as legally possible the right to sue neurodiversity, LLC, Errin Andrew Khav, or any designated employees or contractors of neurodiversity, LLC.

This contract may be signed electronically or in hard copy. If signed in hard copy, it must be returned to the Business for valid record. Electronic signatures count as original for all purposes.

If no signature was collected, the action of making an appointment, utilizing services, or otherwise maintaining contact with the business constitutes your acceptance of these terms in its entirety.
